These Terms & Conditions (“Terms”) govern your access to and use of the Elevation Collective website and services (the “Services”), operated by Elevation Collective Co. (“Elevation Collective,” “we,” “us,” or “our”).

Elevation Collective is powered by Shopify, which enables us to provide the Services to you.

By accessing, browsing, or using the Services, including placing an order, you agree to be bound by these Terms, our Privacy Policy, Cookie Policy, Shipping Policy, and Return & Refund Policy, each of which is incorporated by reference. If you do not agree, you must not use the Services.

If there is a conflict between these Terms and the Privacy Policy, the Privacy Policy controls with respect to the collection, processing, and disclosure of personal information.

1. Eligibility & Use of the Services

By using the Services, you represent that you are at least the age of majority in your jurisdiction and have the legal capacity to enter into this agreement.

You agree to use the Services only for lawful purposes and not to:

  • Violate any applicable laws or regulations

  • Interfere with the security or operation of the Services

  • Attempt unauthorized access to systems or data

  • Use the Services for fraudulent, abusive, or deceptive purposes

We reserve the right to refuse service, suspend access, or cancel orders at our discretion.

2. Products, Services & Business Model

Elevation Collective operates an e-commerce store offering products that may be fulfilled by third-party manufacturers, suppliers, logistics providers, or fulfillment partners.

Product descriptions, pricing, specifications, availability, and images are provided for informational purposes only and may change without notice. We do not guarantee that listings are error-free, complete, or current.

3. Orders, Pricing & Payments

All orders are subject to acceptance and availability.

We reserve the right to:

  • Cancel or refuse any order

  • Limit quantities per customer or order

  • Correct pricing, listing, or typographical errors at any time

Payment must be received in full at the time of purchase. Payments are processed by Shopify and its authorized payment providers in accordance with their respective terms and privacy practices.

Payment Authorization

By submitting payment information, you authorize Elevation Collective Co. and its payment processors to charge your selected payment method for the total amount of your order, including applicable taxes, shipping charges, duties, and any other fees disclosed at checkout.

4. Shipping & Delivery

Shipping and delivery terms are governed by our Shipping Policy, which is incorporated into these Terms.

Delivery dates are estimates only and are not guaranteed. Delays caused by carriers, suppliers, weather, or other factors outside our control do not qualify for refunds once an order has shipped.

Risk of loss transfers to the customer upon delivery.

5. Returns, Refunds & Cancellations

Returns, refunds, exchanges, cancellations, restocking fees, custom-order exclusions, and related conditions are governed by our Return & Refund Policy, which is incorporated into these Terms.

6. Accounts & Security

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Elevation Collective is not responsible for unauthorized access resulting from your failure to safeguard your credentials.

7. Intellectual Property

All content included in the Services, including text, images, graphics, logos, designs, and software, is owned by or licensed to Elevation Collective and protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, display, or exploit any content without prior written consent.

The Services may contain links to third-party websites or services not owned or controlled by Elevation Collective. We are not responsible for the content, accuracy, availability, or practices of third parties.

9. Privacy & Data Use

Your use of the Services is subject to our Privacy Policy, which describes how personal information is collected, used, disclosed, retained, and protected.

The Services are hosted by Shopify, and personal information may be processed by Shopify and its service providers in accordance with applicable law.

We do not warrant that:

  • The Services will be uninterrupted, secure, or error-free

  • Product descriptions, images, or specifications will be completely accurate or current

  • Shipping times or delivery dates will be met

Any reliance on information provided through the Services is at your own risk.

12. Product Representation & Manufacturer Responsibility

Elevation Collective does not manufacture the products sold through the Services. Products are fulfilled by third-party manufacturers, suppliers, or fulfillment partners.

Product images, videos, specifications, dimensions, colors, finishes, and descriptions are provided for illustrative and informational purposes only. Actual products may vary due to manufacturer updates, material availability, production changes, screen/display differences, or other factors beyond our control.

Elevation Collective does not guarantee that:

  • Product images perfectly represent the delivered product

  • Manufacturer specifications will remain unchanged

  • Products will meet subjective expectations or preferences

Manufacturer warranties, where applicable, are provided directly by the manufacturer and are subject to the manufacturer’s terms. Elevation Collective does not provide independent warranties beyond those expressly stated on the applicable product page.

To the extent permitted by law, Elevation Collective is not responsible for:

  • Manufacturer defects or design decisions

  • Changes made by manufacturers after product listing

  • Normal wear and tear

  • Improper installation, use, or maintenance

Customers are responsible for reviewing product details, compatibility, space requirements, and suitability prior to purchase and for following all manufacturer instructions.

13. Limitation of Liability

To the fullest extent permitted by law, Elevation Collective shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Services or purchase of products.

Our total liability shall not exceed the amount paid by you for the product giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless Elevation Collective, its owners, officers, affiliates, and service providers from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

15. Arbitration & Class Action Waiver

PLEASE READ CAREFULLY — THIS AFFECTS YOUR LEGAL RIGHTS

Any dispute, claim, or controversy arising out of or relating to the Services, products, or these Terms shall be resolved by binding arbitration, rather than in court, except that eligible claims may be brought in small claims court.

Arbitration will be conducted on an individual basis under the rules of the American Arbitration Association (AAA) in Delaware before a single neutral arbitrator.

You agree to waive any right to participate in a class, collective, or representative action, and you waive any right to a jury trial.

You may opt out of arbitration within 30 days of first accepting these Terms by providing written notice to:

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict-of-law principles.

17. Changes to These Terms

We may update these Terms from time to time. Changes are effective upon posting. Continued use of the Services constitutes acceptance of the revised Terms.
